When it comes to property transactions, whether you are a buyer or a seller, the process of due diligence is critical. Due diligence refers to the thorough investigation and verification of all relevant aspects of a property before finalizing the purchase or sale. This process ensures that the transaction is legitimate, safe, and free from unexpected risks or complications.
Steps in Property Due Diligence for Buyers
- Title and Ownership Verification: One of the most important aspects of due diligence is verifying the title of the property. Buyers should ensure the seller has a clear and marketable title, meaning they have the legal right to sell the property. It’s essential to verify that there are no encumbrances, disputes, or mortgages on the property. The title deed should be scrutinized for any discrepancies, and the buyer should ensure the seller is the rightful owner.
- Legal Documentation: Buyers must verify all legal documents related to the property. This includes the sale deed, ownership documents, property tax receipts, and any approvals or permits required for construction. In case of properties in residential societies, a No Objection Certificate (NOC) from the society may also be necessary.
- Check for Liabilities: It’s crucial to ensure that there are no outstanding debts, loans, or dues on the property, including unpaid property taxes, utility bills, and pending legal cases. If the property has any liabilities, the buyer may be held responsible after the sale.
- Physical Inspection: Conducting a thorough physical inspection of the property is vital to ensure there are no hidden damages or maintenance issues. This includes checking the foundation, plumbing, electrical systems, and overall structural integrity. Engaging professional inspectors can help identify issues that may not be visible at first glance.
- Verify Zoning and Land Use Regulations: Before purchasing, it’s important to verify that the property complies with local zoning regulations to ensure that the property can be used for the intended purpose, whether it’s residential, commercial, or agricultural.
- Title Documents: Drafting, execution and registration are three important steps in getting clear title property with ownership and possession. Many people avoided Sale / Apartment Deed and stops ate Agreement to Sale / Assignment / Transfer, which result in incomplete title and ownership rights. Many judgements have been passed by Hon’ble Supreme Court of India which explicitly states that Agreements to Sale does not confer ownership to buyer.
