In India, the Code of Civil Procedure, 1908 (CPC) governs the procedural aspects of civil cases in the courts. CPC categorizes various types of civil cases under its provisions. Some of the main civil types of cases that come under CPC in India include:
- Civil Suits: These are cases involving disputes between individuals or entities, typically over property, breach of contracts, or family matters.
- Partition Suits: These involve the division of property among co-owners or family members, mostly within legal heirs of deceased due to unclear division of the properties.
- Recovery Suits: These cases involve the recovery of money or property from one party due to various reasons like, friendly loans, supply of goods or services, faulty or delayed supply of good or services, legal debts and liabilities.
- Specific Performance Suits: These suits are initiated to enforce the specific performance of a contract rather than awarding damages for its breach, mostly related with sale and purchase of properties with part payment of consideration.
- Injunction Suits: An injunction is a legal remedy where the court orders the defendant to do or refrain from doing a certain act. Again these suits are related with disposal of land and property.
- Suit for Declaration: These suits are related to confirm rights of a party, mostly dealing with title of ownership of a property.
- Money Suits: These cases are filed when one party claims money from another for the recovery of debts, or payment for goods and services rendered.
- Suit for Damages: These suit involve claims for monetary compensation due to harm or loss caused by someone’s actions.
- Suit for Rent and Eviction: These cases are related to the relationship between landlord and tenant, including eviction and recovery of unpaid rent.
- Succession and Inheritance Cases: These involve disputes over the distribution of property of the deceased as well confirmation of rights of legal heirs of the deceased who has died without making Will or unclearly drafted or unregistered Will.
- Arbitration and Conciliation Suits: These cases arise when there is a disagreement over an arbitration award or an attempt to enforce an arbitration agreement.
- Execution Suits: These cases involve the enforcement of a court’s judgment or decree.
- Appeals and Revisions: When a party is dissatisfied with a lower court’s decision, they may file an appeal or revision under CPC.
- Contempt of Court Cases: When a person refuses to comply with a court order, they may be held in contempt.
